1. Acceptance of these terms

These Terms of Use (the “Terms”) govern your access to and use of pacificaengnc.com (the “Site”), which is operated by Pacifica Engineering Services, LLC (“Pacifica,” “we,” “us” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. Use of the Site

You may use the Site for lawful purposes, including learning about our services and contacting us about a project. When using the Site, you agree that you will not do any of the following.

• Use the Site in a way that violates any law or regulation.
• Attempt to gain unauthorized access to the Site, its servers or any connected system.
• Interfere with the operation of the Site, including through malicious code, automated scraping or excessive requests.
• Submit false, misleading or unlawful information, or impersonate another person or organization.
• Copy, frame or redistribute content from the Site except as these Terms allow.

3. No professional advice

The content on the Site is general information about Pacifica and the services we offer. It is not engineering advice and must not be relied on for the design, permitting, bidding or construction of any project. Site conditions, codes and project requirements vary, and engineering judgment can only be applied to a specific project under a written agreement.

4. No engineer and client relationship

Using the Site, submitting the project inquiry form or emailing us does not create an engineer and client relationship, and it does not obligate either party to proceed. A professional relationship begins only when Pacifica and the client sign a written agreement that defines the scope of services, compensation and other terms.

5. Illustrative drawings

Drawings, plans, sections, maps and diagrams on the Site are illustrations created for this website. They do not depict actual projects unless stated, are not to scale unless noted, and are not for construction.

6. Information you send us

Information you send through the Site is handled as described in our Privacy Policy. Please do not send confidential, proprietary, export controlled or security sensitive information through the Site. Sending information through the Site does not create a duty of confidentiality beyond that policy until a written agreement or nondisclosure agreement is in place, and it does not obligate us to respond or take any action.

7. Intellectual property

The Site and its content, including text, drawings, graphics, the Pacifica Engineering name and logo, and the selection and arrangement of content, are owned by Pacifica Engineering Services, LLC or its licensors and are protected by copyright, trademark and other laws. You may view and print pages for your own information or for internal business use in evaluating our services. Any other use, including copying, modifying, distributing or creating derivative works, requires our prior written permission.

8. Links to other websites

The Site may link to websites and services operated by others, such as mapping services. We do not control and are not responsible for their content, policies or practices, and a link does not mean we endorse them.

9. Disclaimer of warranties

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Pacifica disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and noninfringement. We do not warrant that the Site will be uninterrupted, error free or free of harmful components.

10. Limitation of liability

To the fullest extent permitted by law, Pacifica and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or business, arising out of or related to your use of the Site or your reliance on its content, even if advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be limited under applicable law. Nothing in these Terms changes the terms of any signed professional services agreement between Pacifica and a client, which will control for the services it covers.

11. Indemnification

You agree to indemnify and hold harmless Pacifica and its owners, employees and agents from any claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these Terms.

12. Governing law and venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law rules. Any dispute arising out of these Terms or the Site will be brought only in the state or federal courts located in North Carolina, and you consent to the jurisdiction of those courts.

13. Changes to these Terms

We may revise these Terms at any time by posting an updated version on this page with a new effective date. Your continued use of the Site after a change means you accept the revised Terms.

14. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of it. These Terms and our Privacy Policy are the entire agreement between you and Pacifica about your use of the Site.
